License

1. License Grant

1.1. Dynasonde Solutions Ltd. grants to the Tomsk State University a non-exclusive, non-assignable, copyright license to use the Dynasonde 21 Software Suite.

1.2. The time period of the License is not limited.

1.3. Dynasonde Solutions Ltd. grants to the Tomsk State University a non-exclusive, non-assignable copyright license to modify portions of the Dynasonde 21 Software Suite that are provided in Source Code form.

1.4. Tomsk State University shall have the right to combine the Dynasonde 21 Software Suite with any other software and/or peripheral devices.  Any disruption of system performance caused by such action is not the reponsibility of the Dynasonde Solutions Ltd.

2.  License Restrictions

2.1. Copying of the Dynasonde 21 Software Suite is permitted only for backup or archival purposes.  The copy may not be provided to another user.

2.2. Tomsk State University may NOT:  (i) use or copy the Dynasonde 21 Software Suite except as provided in this License Agreement; (ii) rent or lease the Dynasonde 21 Software Suite to any third party; (iii) assign this Agreement or transfer the Dynasonde 21 Software Suite without the express written consent of Dynasonde Solutions Ltd.; (iv) reverse engineer, decompile, or disassemble the Software; (v) distribute, sublicense or transfer the Source Code form of any components of the Dynasonde 21 Software Suite and derivatives thereof to any third party except as provided in this Agreement.

2.3. The Dynasonde 21 Software Suite may be used only with a single installation of the High Frequency Radar System.

2.4. Tomsk State University may permanently transfer all of his rights under this Agreement only with Dynasonde Solutions Ltd.'s prior written permission.

3. Copyright

Title to the Dynasonde 21 Software Suite and all copies thereof remain with the Dynasonde Solutions Ltd.. The Dynasonde 21 Software Suite is copyrighted and are protected by United States copyright laws and international treaty provisions. Tomsk State University will not remove any copyright and/or authorship notice from the Dynasonde 21 Software Suite.  Tomsk State University agrees to prevent any unauthorized copying of the Dynasonde 21 Software Suite.  Except as expressly provided herein, no license or right is granted to Tomsk State University directly or by implication.
